I don't see why corporations are necessarily "fictions of the state", at least taking a broader view of the term. A non-state legal organization (court) could treat certain companies registered with them as separate legal entities from their owners, for pruposes at least of convenience. That's really not much different from a corporation, excepting that limited liability would probably be a more limited concept (link: Rothbard's thoughts on limited liability).

Of course. I'm referring to the present state, specifically. It's possible that unhampered markets would have a more diverse set of firm structures in the absence of companies law incentives.
